These Terms of Service (“Terms”) govern your access to and use of our website, products, and services (collectively, the “Services”). By visiting our site or purchasing from us, you agree to be bound by these Terms and our other policies referenced below.

1) Eligibility & Account

  • You must be the age of majority in your province/state of residence to purchase.

  • You are responsible for maintaining the confidentiality of any account credentials and for all activity under your account.

2) Orders & Acceptance

  • All orders are offers to purchase. We may accept or reject any order for any reason, including availability, suspected fraud, or pricing/description errors.

  • If we cancel after you’ve been charged, we’ll issue a refund for the canceled items.

3) Pricing, Payments & Taxes

  • Prices are listed in CAD unless stated otherwise and are subject to change without notice.

  • We accept payment methods shown at checkout. By submitting payment information, you authorize us (and our payment processors) to charge the full order amount, including applicable taxes, shipping, and fees.

  • You are responsible for all applicable taxes, duties, and import fees based on your shipping destination.

4) Shipping, Risk & Title

  • Shipping options, costs, and estimated delivery times are shown at checkout. Estimates are not guarantees.

  • Title and risk of loss pass to you upon delivery to the shipping address shown on the carrier’s official tracking.

  • You are responsible for providing an accurate, complete address. We are not liable for non-delivery due to address errors or unclaimed packages.

5) Returns, Exchanges & Order Issues

  • All Sales Final. We do not accept returns, exchanges, or cancellations for change of mind.

  • If your order arrives damaged, defective, or incorrect, email orders@casualcarnage.ca within 7 days of delivery with your order number, photos of the item and packaging, and a description of the issue. If approved, we will resolve via replacement or store credit at our discretion (refunds only where required by law).

6) Product Information & Availability

  • We aim for accuracy, but errors (e.g., descriptions, pricing, images, availability) may occur. We reserve the right to correct errors, update information, or cancel orders if any information is inaccurate at any time without prior notice.

7) Promotions, Gift Cards & Store Credit

  • Promotions/coupons have terms and may not be combined unless stated.

  • Gift cards and store credit are non-refundable, not redeemable for cash (except where required by law), and lost/stolen cards will not be replaced.

8) Prohibited Uses

You agree not to use the Services to:

  • Violate laws or infringe the rights of others.

  • Upload or transmit malware or interfere with site security.

  • Scrape, crawl, or harvest data without written permission.

  • Resell or export products in violation of applicable laws.
    We may suspend or terminate access for any prohibited use.

9) User Content (Reviews, Submissions)

If you post reviews, photos, or other content (“User Content”):

  • You represent you own or control the rights to the content and that it’s accurate, lawful, and non-infringing.

  • You grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish, translate, distribute, and display the content in any media for marketing and operational purposes.

  • We may remove or edit User Content at our discretion.

10) Intellectual Property

All content on the site (including logos, graphics, text, designs, and images) is owned by or licensed to Casual Carnage Clothing Company and protected by law. You may not copy, distribute, modify, or create derivative works without our prior written consent.

11) Third-Party Services

Our store is hosted and/or supported by third-party providers (e.g., ecommerce, payments, shipping). Your use of those features may be subject to their terms and privacy policies. We are not responsible for third-party services we do not control.

12) Mobile Messaging (If You Opt In)

If you opt in to receive SMS or similar messages:

  • You consent to receive automated marketing and transactional messages. Consent is not a condition of purchase.

  • Message/data rates may apply; message frequency varies.

  • You can reply STOP to opt out and HELP for help. Carriers are not liable for delayed or undelivered messages.

13) Disclaimer of Warranties

Except as required by law, the Services and all products are provided “as is” and “as available” without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, and non-infringement). We do not warrant uninterrupted or error-free operation.

14) Limitation of Liability

To the maximum extent permitted by law, in no event shall Casual Carnage Clothing Company (and our directors, officers, employees, and agents) be liable for any indirect, incidental, special, consequential, punitive, or lost-profits damages arising from or related to the Services, products, or these Terms. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

15) Indemnification

You agree to defend, indemnify, and hold harmless Casual Carnage Clothing Company from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms or misuse of the Services.

16) Suspension & Termination

We may suspend or terminate your access to the Services at any time, for any reason, including suspected violations of these Terms or illegal/fraudulent activity.

17) Changes to the Services & Terms

We may update the Services and these Terms at any time. Changes take effect when posted on our site with the “Effective date” above. Your continued use after changes means you accept the updated Terms.

18) Governing Law & Disputes

These Terms are governed by the laws of Manitoba and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in Winnipeg, Manitoba to resolve any dispute arising out of or relating to these Terms or the Services.

19) Severability & Entire Agreement

If any provision is found unenforceable, the remaining provisions remain in full force. These Terms, together with our Privacy Policy, All Sales Final Policy, and any additional policies referenced at checkout, constitute the entire agreement between you and us regarding the Services.
